Sharia

In the Name of Allah, the Gracious, the Merciful 

The word شريعة (Sharia) is bandied around, all over the world, even without knowing what it really means. Non-Muslims consider it to be a sinister, medieval code of harsh laws. Muslims themselves are responsible for this perception! Some of the Muslim countries have made it obligatory for men to have long beards and for women to have a complete head to feet covering in public, and such other archaic laws, as part of شريعة. Such archaic laws are not part of the Qur’aanic شريعة. The شريعة as understood by those Muslim countries is based, on man-written books, published long after the death of Prophet Muhammad (peace be upon him).

In the Qur'aan, this word is mentioned in Verse 45:18 whereby Prophet Muhammad was informed that he himself was created with the divine code of conduct inherent in him. This code of conduct, inherent in the Prophet, is the Message of the Qur'aan! So, شريعة must be explored within the Qur'aan itself! Seeking its meaning outside the Qur'aan has led the Muslims astray. 

What then is the Code of Conduct (شريعة) laid down in the Qur’aan?

Summarised, for the sake of this short article, the essentials of this Code are as under:

1. Belief in Allah.

2. Belief in the Qur'aan being  a Message from Allah.

3. Belief in the Hereafter. 

4. Standing firmly for justice and truth.

I would elaborate on the essentials above as under:

The Universe and everything therein are so intricately and intelligently interlinked that the concept of their coming into being of their own accord, is just nonsense, even from the scientific point of view! From the same point of view, it would be nonsense to say that their creators are more than one.

The Unitary Power that created everything is called Allah in Islam. The Power could be called by any other appropriate name.

Allah has sent mankind to this earth for testing their eligibility for an everlastingly happy life in the Hereafter. There is another life after death, which is the Hereafter. Only those will be eligible to be happy there who have led شريعة lives here, at least during the last phase before death. The others go to Hell there!

The dos and the don'ts in the Qur’aan constitute the شريعة. The dos are all good things like truthfulness, honesty, kindness, sympathy, and ways and means to cultivate these. And the don'ts are all bad things like theft, treachery, oppression, dishonesty, falsehood, and ways and means employed for their perpetration.

People are urged to boldly stand for justice and truth even when it goes against their own selves or their near and dear ones.

Much ado is raised about the punishment of cutting a hand for theft (Verse 5:38). In the very next Verse (5:39), the perpetrator of the crime is pardoned if he/she repents and makes amends. The provision of a harsh punishment serves only as a deterrent. Only a repeater of the crime may suffer the harsh punishment. Even then it must be remembered that this punishment can be awarded only by a State governed strictly under Qur'aanic شريعة. In such a state, the judge would be an Allah-fearing person, who would not award the harsh punishment unless he is sure, without a shadow of a doubt, that the person concerned has indeed committed the crime. So, this is a case of much ado about nothing!

Question is also raised as to why a daughter inherits only half the share of a son, under the شريعة. Those who raise this question do not know that in Islam, the responsibility of bearing the family expenses is on a male member and not on a female. Moreover, a wife gets shares in inheritance both from her parents' side and from the husband's side. A husband gets inheritance only from his parents' side. And there are other aspects to this issue that are beyond the scope of this short article.

In Islam, sexual enjoyment is restricted within the bounds of marriage. Taking this outside these bounds generate many evils that would be bad for a good human society. The Qur'aanic شريعة has therefore put certain behavioural and dressing norms to avoid sexual provocation in public. But these norms do not prevent females from acquiring education or doing any normal Societal work in public as wrongly professed in some quarters.

The Qur'aanic شريعة, in short, is designed to generate a free and secure society for all mankind - even for those who do not believe in Allah, in the Qur'aan, and in the Hereafter. They will be dealt with by Allah Himself in the Hereafter. No earthly authority has any power to punish them for that unless they indulge in some crime against their fellow human beings.

It is not very important to have a high position in the life of this world. What is important is to qualify here for a place in Paradise. There is no harm in trying to get some important and fair position on this earth, but that should be done by fair means, not foul.

Condition of Muslims

For about 9 centuries, from the 7th century AD, Muslims, as a community, had been in a good position, politically or even otherwise, on a large part of this world. But gradually, the community lost its Muslim character, and, consequently, lost its good position too. The Muslims are still in ruling positions in some countries, but they carry no weight, internationally.

The Qur'aanic Verse 13:11 tells us that Allah does not change a community's condition until it changes its own character (ان الله لا يغيرو ما بقوم حتى يغيرو ما بانفسهم ٠٠٠). The Muslims themselves are responsible for their continually worsening condition. Most of today's Muslims do really have no faith in Allah. Their minds entertain doubts even about the existence of Allah. And they doubt the divine authorship of the Qur'aan! That is why they do not try to follow the Qur’aan, in letter, and in spirit.

ہمیں شک ہے کہ شک ہی میں غرق ہو جاینگے ہم 

جانتے بوجھتے، دیکھتے ہی دیکھتے، ﷲ کی مار کھاینگے ہم۔ 

(We are in doubt that in doubt itself we're going to drown

Knowingly, imminently, we're going to suffer Allah's frown)

In the very same Verse quoted above, the Qur'aan informs us that when Allah wills calamity on any community, none, other than He Himself, can avert it.

May Allah have mercy on us!

Indivisible

 In the Name of Allah, the Gracious, the Merciful


The Qur'aan says in Verse 6:159, 'Those indeed who have broken the unity of their Faith, and have become sects, you have nothing to do with them ...'.

From the above, the divine dislike of dividing Islam into sects is obvious! But what is noteworthy is the arithmetical or numerical code used here to give expression to the divine concept of the indivisibility of Islam.

The believers are addressed as يا أيها الذين آمنوا (O you who believe) throughout the Qur'aan for being given necessary instructions on leading a proper life on this earth. And they are so addressed, in all, 89 times therein. 89 is an indivisible prime number!

So, you see, the divine concept of the indivisible Islam is codified here by addressing the believers for a prime number of times - a feat that could only be divine, and not man-made - in the circumstances in which the Qur'aan was revealed, nearly 1500 years ago!

And the Qur'aan is replete with such numerical codes leaving no scope for any doubts about its divinity!!

Attalaaq

The title above is the Arabic word الطلاق in Roman script. I came across this word while going through the Verses of the Qur'aan on divorce.

The Qur'aanic phrase containing the said word, that came to my notice first, was الطلاق مرتان meaning الطلاق is twice (Verse 2:229). I have discussed the Qur'aanic meaning of الطلاق elsewhere (refer the blog post

What I want to draw attention to, here, are the wonderful, superhuman arithmetical codes that the Qur'aan is replete with. The plain meaning of the aforesaid Arabic phrase is of course that الطلاق can be resorted to only twice by a married couple during the duration of their marriage.

But I was pleasantly astonished to find out that an arithmetical code is hidden in the said Arabic phrase too! 

The code is that the word الطلاق has occurred only TWICE throughout the entire Qur'aan!!

 

And this is not the only instance of the use of secret arithmetical codes. There are instances galore throughout the Qur'aan!

 

And remember that the Qur'aan was revealed not all at once but in parts, during the long course of 23 years in the 7th century AD, when none of the modern amenities was available. Not even paper!

 

Would you still, then, not believe that the Qur'aan is divine and not man-made!?

FRIDAY SERMONS: Abusive Attitude

 

IN THE NAME OF ALLAH, THE GRACIOUS THE MERCIFUL


The Qur'aan repeatedly asserts that it is well explained within itself. And,  yet, most Muslims - almost all of their religious leaders included - believe that the Qur'aanic term الربا is not defined therein. 


But when I questioned their thus openly contradicting the Qur'aan (refer What Is Ar-Riba ), l received an abusive response! The response was not a reasoned one, but just abusive. I was told, "Shame on you 
You jahil retard.
How many days are left behind for your life?
When you will repent you you want to die with your sinful and corrupt fake ideology?" 

Such abusive language is unbecoming of a Muslim. The Qur'aan directs us to be kind even while arguing with others (Verse 29:46).

I request all my Muslim brothers and sisters never to use such abusive language. It gives Islam a falsely bad name.

FRIDAY SERMONS: Reading the Qur'aan


In my childhood, I do not remember any elder urging me to understand what I read of the Qur'aan! It was the general belief then that it was enough for a child to learn how to read it. Understanding it was never stressed upon!


This reprehensible attitude prevails even now, although the Qur'aan asks أفلا يتدبرون القرآن Will they not, then, ponder over the Qur'aan?... [Verse 47:24]


The ugly fact of the matter is that the so-called Muslims generally have abandoned thein Qur'aan, and have thus abandoned the Protective Hand of Allah!

Extract from QUR’AANIC STUDIES – A Modern Tafsir PART I:

101. Ya ayyuha allatheena amanoo la tas-aloo AAan ashyaa in tubda lakum tasu/kum wa-in tas-aloo AAanha heena yunazzalu alqur-anu tubda lakum AAafa Allahu AAanha waAllahu ghafoorun haleemun


5:101. O you who believe! Do not put questions about things, which, if clarified to you, may cause difficulties for you. And if you put questions about them when the Qur’aan is being revealed, they may be clarified to you. Allah has absolved you of any obligation thereon.40 And Allah is Forgiving, Kind.


40. This Verse makes it clear that in matters in which the Qur'aan is silent, mankind has freedom of action.

130. Ya ayyuha allatheena amanoo la ta/kuloo alrriba adAAafan mudaAAafatan waittaqoo Allaha laAAallakum tuflihoona

3:130. O you who believe! Consume not Ar-Riba143, doubled, and multiplied. And fear Allah, so that you attain salvation.

143. …. Ar-Riba got totally prohibited under Verse 2:275, and Verse 3:130, the one we are studying now, was revealed earlier in chronological order of revelation. So, at the time of the revelation of Verse 3:130, Ar-Riba was not totally prohibited. But by this Verse, the believers were asked not to consume Ar-Riba at exorbitant rates. This is in line with the divine scheme of inducting prohibition of long-entrenched harmful human habits in gradual steps. Prohibition of intoxicants was also similarly done….

3:100. O you who believe! If you follow any faction of those upon whom the divine Book was bestowed earlier, they will turn you back to suppressing the Truth after you have come to believe!

278. Ya ayyuha allatheena amanoo ittaqoo Allaha watharoo ma baqiya mina alrriba in kuntum mu/mineena

2:278. O you who believe! Fear Allah and give up what has remained of Ar-Riba, if you are indeed believers.519

519. Recall divine Rulings, Warnings and Directions made in Verses 2:275 and 2:276. The divine admonition, here in Verse 2:278, is in pursuance thereof.

Excerpts from QUR’AANIC STUDIES – A Modern Tafsir PART I:
183. Ya ayyuha allatheena amanoo kutiba AAalaykumu alssiyamu kama kutiba AAala allatheena min qablikum laAAallakum tattaqoona

2:183. O you who believe! The fasting is prescribed for you as it was prescribed for those who lived before you, so that you become pious.305

305. And the pious are the ones who are on the right Guidance and successful, the All-knowing Allah assures us (refer Verses 2:2 to 2:5)! In other words, fasting opens the door to real success in this world and to salvation in the Hereafter. To achieve success in its real sense, therefore, one has got to fast in the divinely prescribed manner.

178. Ya ayyuha allatheena amanoo kutiba AAalaykumu alqisasu fee alqatla alhurru bialhurri waalAAabdu bialAAabdi waalontha bialontha faman AAufiya lahu min akheehi shay-on faittibaAAun bialmaAAroofi waadaon ilayhi bi-ihsanin thalika takhfeefun min rabbikum warahmatun famani iAAtada baAAda thalika falahu AAathabun aleemun


2:178. O you who believe! Prescribed for you, is the capital punishment in the matter of murdered persons. If a free man, a slave/servant or a female commits the crime, this prescribed punishment would accordingly be applicable only to that free man, that slave/servant or that female, respectively. But where the guilty person’s fellow citizen concerned commutes the sentence, the commutation must be adequately implemented, and the guilty person must fulfil the terms of commutation in good measure. That is a remission from your Lord, and His grace! Then whoever transgresses thereafter – for him shall there be a painful punishment.293 to 296


293. Advocates of abolition of capital punishment, beware! You cannot change what the Creator Himself has laid down. But it should well be noted that, in the light of Verse 4:92, capital punishment would be applied only to cases of intentional murder, and not to killing by mistake. And, of course, it is not applicable to killings in a war.
294. The Arabic al-quisuaasu basically means retaliation – a tit-for-tat response. In the context of an intentional murder, therefore, I have rendered the Arabic word as 'capital punishment' in the translation.
295. Literally translated, the second sentence of the Verse would look like, 'The free man, to the free man ...' In the context of the first sentence, it would obviously mean, 'If the murder is committed by a free man, the capital punishment would be meted out to that free man ...' To avoid any mistake in and consequent misconception of a literal rendering, a free renderiong is done, as in the second sentence of this English translation of the Verse.
296. In some translations, the Arabic term min akheehi occurring in this Verse, is so rendered as to mean 'the murdered person's brother'. But there is no justification for relating the possessive pronoun hi (his) here to the murdered person, as he/she (the murdered person) is not mentioned earlier in this Verse or in the immediately preceding Verses. The murderer, on the other hand, is mentioned. And it would be blasphemous to expect a mistake in a divine script. Moreover, akhee, in Qur'aanic terminology, does not necessarily mean only the close blood relationship of a brother. It often means (as for example in Verse 27:45) a fellow human of the same group, community or nation. Min akheehi would therefore mean any human being, duly authorised by the community, in which the murder is committed, to examine the case and pronounce his judgement or grant commutation of the death penalty. I have hence rendered min akheehi as 'the guilty person's fellow citizen concerned' in the translation. Besides, this divine provision for commutation, it may be noted, would take care of cases of murder committed, inter alia, under intense provocation.

4:40. Indeed, Allah wrongs not even to the infinitesimal extent of the weight of an atom. And if there is a good deed, He doubles it and bestows, from Him, a great reward.

Worldly Life

185. Kullu nafsin tha-iqatu almawti wa-innama tuwaffawna ojoorakum yawma alqiyamati faman zuhziha AAani alnnari waodkhila aljannata faqad faza wama alhayatu alddunya illa mataAAu alghuroori


3:185. Everyone must taste the death. And only on the Resurrection Day, shall your earnings be fully paid. So then, whoever is moved away from the Fire and admitted to the Garden, he indeed has achieved success. And the life of this world is nothing but ways and means of deception.

Suppressors of Truth

178. Wala yahsabanna allatheena kafaroo annama numlee lahum khayrun li-anfusihim innama numlee lahum liyazdadoo ithman walahum AAathabun muheenun


3:178. And let not the suppressors of the Truth think that the long rein We give them is any good for them. The long rein to them is only for the purpose that they may add to their sins. And for them is a disgraceful punishment.
