Sharia

In the Name of Allah, the Gracious, the Merciful 

The word شريعة (Sharia) is bandied around, all over the world, even without knowing what it really means. Non-Muslims consider it to be a sinister, medieval code of harsh laws. Muslims themselves are responsible for this perception! Some of the Muslim countries have made it obligatory for men to have long beards and for women to have a complete head to feet covering in public, and such other archaic laws, as part of شريعة. Such archaic laws are not part of the Qur’aanic شريعة. The شريعة as understood by those Muslim countries is based, on man-written books, published long after the death of Prophet Muhammad (peace be upon him).

In the Qur'aan, this word is mentioned in Verse 45:18 whereby Prophet Muhammad was informed that he himself was created with the divine code of conduct inherent in him. This code of conduct, inherent in the Prophet, is the Message of the Qur'aan! So, شريعة must be explored within the Qur'aan itself! Seeking its meaning outside the Qur'aan has led the Muslims astray. 

What then is the Code of Conduct (شريعة) laid down in the Qur’aan?

Summarised, for the sake of this short article, the essentials of this Code are as under:

1. Belief in Allah.

2. Belief in the Qur'aan being  a Message from Allah.

3. Belief in the Hereafter. 

4. Standing firmly for justice and truth.

I would elaborate on the essentials above as under:

The Universe and everything therein are so intricately and intelligently interlinked that the concept of their coming into being of their own accord, is just nonsense, even from the scientific point of view! From the same point of view, it would be nonsense to say that their creators are more than one.

The Unitary Power that created everything is called Allah in Islam. The Power could be called by any other appropriate name.

Allah has sent mankind to this earth for testing their eligibility for an everlastingly happy life in the Hereafter. There is another life after death, which is the Hereafter. Only those will be eligible to be happy there who have led شريعة lives here, at least during the last phase before death. The others go to Hell there!

The dos and the don'ts in the Qur’aan constitute the شريعة. The dos are all good things like truthfulness, honesty, kindness, sympathy, and ways and means to cultivate these. And the don'ts are all bad things like theft, treachery, oppression, dishonesty, falsehood, and ways and means employed for their perpetration.

People are urged to boldly stand for justice and truth even when it goes against their own selves or their near and dear ones.

Much ado is raised about the punishment of cutting a hand for theft (Verse 5:38). In the very next Verse (5:39), the perpetrator of the crime is pardoned if he/she repents and makes amends. The provision of a harsh punishment serves only as a deterrent. Only a repeater of the crime may suffer the harsh punishment. Even then it must be remembered that this punishment can be awarded only by a State governed strictly under Qur'aanic شريعة. In such a state, the judge would be an Allah-fearing person, who would not award the harsh punishment unless he is sure, without a shadow of a doubt, that the person concerned has indeed committed the crime. So, this is a case of much ado about nothing!

Question is also raised as to why a daughter inherits only half the share of a son, under the شريعة. Those who raise this question do not know that in Islam, the responsibility of bearing the family expenses is on a male member and not on a female. Moreover, a wife gets shares in inheritance both from her parents' side and from the husband's side. A husband gets inheritance only from his parents' side. And there are other aspects to this issue that are beyond the scope of this short article.

In Islam, sexual enjoyment is restricted within the bounds of marriage. Taking this outside these bounds generate many evils that would be bad for a good human society. The Qur'aanic شريعة has therefore put certain behavioural and dressing norms to avoid sexual provocation in public. But these norms do not prevent females from acquiring education or doing any normal Societal work in public as wrongly professed in some quarters.

The Qur'aanic شريعة, in short, is designed to generate a free and secure society for all mankind - even for those who do not believe in Allah, in the Qur'aan, and in the Hereafter. They will be dealt with by Allah Himself in the Hereafter. No earthly authority has any power to punish them for that unless they indulge in some crime against their fellow human beings.

It is not very important to have a high position in the life of this world. What is important is to qualify here for a place in Paradise. There is no harm in trying to get some important and fair position on this earth, but that should be done by fair means, not foul.

Condition of Muslims

For about 9 centuries, from the 7th century AD, Muslims, as a community, had been in a good position, politically or even otherwise, on a large part of this world. But gradually, the community lost its Muslim character, and, consequently, lost its good position too. The Muslims are still in ruling positions in some countries, but they carry no weight, internationally.

The Qur'aanic Verse 13:11 tells us that Allah does not change a community's condition until it changes its own character (ان الله لا يغيرو ما بقوم حتى يغيرو ما بانفسهم ٠٠٠). The Muslims themselves are responsible for their continually worsening condition. Most of today's Muslims do really have no faith in Allah. Their minds entertain doubts even about the existence of Allah. And they doubt the divine authorship of the Qur'aan! That is why they do not try to follow the Qur’aan, in letter, and in spirit.

ہمیں شک ہے کہ شک ہی میں غرق ہو جاینگے ہم 

جانتے بوجھتے، دیکھتے ہی دیکھتے، ﷲ کی مار کھاینگے ہم۔ 

(We are in doubt that in doubt itself we're going to drown

Knowingly, imminently, we're going to suffer Allah's frown)

In the very same Verse quoted above, the Qur'aan informs us that when Allah wills calamity on any community, none, other than He Himself, can avert it.

May Allah have mercy on us!

Friday Prayer

The Qur'aanic Verse 62:9 (و اذا ندى للصلاة من يوم الجمعة ٠٠٠) stipulates that when the call for the Friday prayer is given, the believers should abandon worldly business and hasten towards meditation on Allah. And the next Verse tells them that this restriction ends at the completion of the Friday prayer. So, the duration of the restriction is only about an hour! Such restriction, on the other hand, was extended to an entire day - Sabbath - for the Jews. We, Muslims, ought to be thankful to Allah Almighty for this concession!

But what do we do? We try our best to get over this little restriction even, in dubious ways. Some of us say that the أذان (call for prayer) with which the restriction starts is not the first, but the second one given just before the ritual congregational prayer starts. The ritual prayer lasts for less than 10 minutes. So, the duration of the restriction would be 10 minutes at the most!

This is just nonsense! The 2nd اذان is given when the people are already engaged in ذكر الله at the places of prayer! They are not engaged in their worldly affairs then. It is the first اذان that the Verses mentioned above refer to. At the first اذان most people are indeed engaged in their worldly affairs. The اذان serves as a notice to them to abandon those affairs and prepare themselves for ذكر الله.

This divine restriction is for all believers, both male, and female. But the females, particularly those in the Indian subcontinent, consider themselves exempted. They remain engaged in their household activities during this restricted time!

When Muslims are so openly unmindful about divine instructions to them, why would Allah Almighty care for them? They have consequently become the favourite whipping boys for any Tom, Dick, or Harry of this world, today!

The Qur'aan prescribes exact timings for the Dawn and Dusk prayers. The Dawn prayer time ends at Sunrise. 

But I have seen many of those who are very close to me that they make it a habit to get up and pray after the Sun rises!

They seemingly to be unaware of the statement, loud and clear, that they thus make that they do not believe the Qur'aan to be divine!!

Jared Akhtar, the self-proclaimed atheist, openly says it is not, but people who do not adhere to Qur'aanic edicts, knowingly, also thus proclaim their disbelief.

On this auspicious day of Eid, I appeal to all my dear and near one's - and to all Muslims - to adhere to Qur'aanic edicts, in letter and in spirit, in order to achieve real success that matters,

34. Ya ayyuha allatheena amanoo inna katheeran mina al-ahbari waalrruhbani laya/kuloona amwala alnnasi bialbatili wayasuddoona AAan sabeeli Allahi waallatheena yaknizoona alththahaba waalfiddata wala yunfiqoonaha fee sabeeli Allahi fabashshirhum biAAathabin aleemin


9:34. O you who believe! Indeed, many of the rabbis and the priests eat away people’s property falsely and turn them away from Allah's Path.15 And to those, who hoard up gold and silver and do not spend it in Allah's Path, announce a painful punishment,


15. At the time of the revelation of the Qur’aan, the religious leaders of the Jews and the Christians did this, but now, Muslim religious leaders too do it.

102. Ya ayyuha allatheena amanoo ittaqoo Allaha haqqa tuqatihi wala tamootunna illa waantum muslimoona

3:102. O you who believe! Fear Allah as He should be feared and die not but as those who have surrendered themselves completely to Allah.120

120. Death may come without any warning signals. Man should therefore never postpone surrendering himself to any future date. That future date may never come in his life.

153. Ya ayyuha allatheena amanoo istaAAeenoo bialssabri waalssalati inna Allaha maAAa alssabireena

2:153. O you who believe! Seek help with patience and prayer. Certainly, Allah is with those who are patient! 246

246. Allah does certainly not promise a bed of roses for the believers in this world. In order that they enjoy the Utopia in the Hereafter, they must go through a test by fire, so to say, in this life! Only two Verses later, in Verse 2:155, Allah tells us that we will be tested with fear, hunger and with losses in property, life and produce! And He asks us to seek His help with prayers, while on trial in this world, but that we shouldn't expect an immediate reward. We must wait patiently for it. Life on earth is indeed a severe test of our Faith! But happiness is a state of mind. We can be happy even in the most trying circumstances, if our Faith is so strong as to make us certain that our very Creator and Lord is with us.

29. Ya ayyuha allatheena amanoo la ta/kuloo amwalakum baynakum bialbatili illa an takoona tijaratan AAan taradin minkum wala taqtuloo anfusakum inna Allaha kana bikum raheeman

4:29. O you who believe! Do not consume your property among yourselves wrongfully; except that you do it by way of trading with mutual consent. And commit no suicides, nor kill one another amongst you! Indeed, Allah is Merciful to you.

3:139. Be not weak and grieve not! And you should be better off if you are strong in Faith.151


151. And most Muslims of today are not strong in their Faith. So, they are weak as a community, and they grieve a lot.

Qur'aan Seldom followed

23. Alam tara ila allatheena ootoo naseeban mina alkitabi yudAAawna ila kitabi Allahi liyahkuma baynahum thumma yatawalla fareequn minhum wahum muAAridoona

3:23. Have you not seen those who have been given a share from the Book? They are called upon to refer to the Book of Allah to settle things among themselves. A section of them then back out and turn hostile.24

24. Initially, at the time of revelation, this Verse obviously referred to the Jews or the Christians as being those given a share of the Book. But in our present times, it very well refers to Muslims who have been given the Qur'aan. The Muslims seldom refer to the Qur'aan, for settlements of disputes among themselves. At the time of writing of these comments, the Muslim Ummah is faced with the unseemly spectacle of Muslims celebrating EidulFitr on different days, not only in the different parts of the world, but also in different parts of the same country! The Muslim Ummah is not at all bothered to follow what the Qur'aan says in this regard. They would rather follow a hadeeth, no matter it leads them to follow a calendar, untenable and impracticable in the present circumstances when Islam has become a fast-growing world Religion. Jews & Muslims

63. Wa-ith akhathna meethaqakum warafaAAna fawqakumu alttoora khuthoo ma ataynakum biquwwatin waothkuroo ma feehi laAAallakum tattaqoona

2:63. And that time when We took your pledge and raised the Mountain over you! 70 "Hold on to what We have given you steadfastly! And do repeatedly refer to and remember its contents in order that you become pious!"71

70. We get further explanation on this episode, in the history of the Children of Israel, in Verse 7:171. The mountain was so raised over them (i.e. Moses' people) that they thought it was about to fall on them. Allah thus used even coercion to make the recalcitrant Jews abide by the Book of Allah given to Moses. HE does that even now to the so-called Muslims to make them abide by the Qur'aan. HE coerces them by involving them in some or the other calamity or ignominy every now and then. And we are very much the witnesses thereto! But alas! The Muslims of today generally are as recalcitrant as the Jews had been during Moses' time.
71. This divine command was ostensibly given to the Jews. But it is as if Allah is telling the Muslims of today: 'Hold on to the Qur'aan steadfastly! And do repeatedly refer to and remember its contents in order that you become pious!' Are there any amongst us, listening to the divine Whisper, my fellow Muslims?

30. Wama asabakum min museebatin fabima kasabat aydeekum wayaAAfoo AAan katheerin

42:30. And whatever calamity befalls you, it is because of what your own hands have earned.6 And much He pardons.

6. Modern-day Muslims, beware! You yourselves are responsible for the ignominy you are suffering.

People of the Book

Extract from Chapter 3 of QUR’AANIC STUDIES – A Modern Tafsir:

110. Kuntum khayra ommatin okhrijat lilnnasi ta/muroona bialmaAAroofi watanhawna AAani almunkari watu/minoona biAllahi walaw amana ahlu alkitabi lakana khayran lahum minhumu almu/minoona waaktharuhumu alfasiqoona

110. You are a better people, picked up for mankind, to enjoin what is right and to forbid what is wrong, and to believe in Allah.127 And had the People of the Book believed, it would certainly be better for them. Among them are some who believe, but most of them are dissolute.128

127. This is a divine confirmation that the task of propagating Islam, the Allah-chosen and Allah-perfected Religion for mankind, has been entrusted to the followers of the Qur'aan, after the death of Prophet Muhammad (peace be upon him).
128. Although at the time of the revelation of the Qur'aan, the epithet 'people of the Book' was applied to the Jews and the Christians it is applicable now to the Muslims as well. They (the Muslims) too are given a divine Book, and among them too there are some who do believe, but most have gone astray.

Muslim Position


On the Editorial Page of the Indian Express issue dated December 27, 2017, there is an article giving a frank analysis of the position the Muslims find themselves in. The article in question is entitled ‘The Other, The Enemy’ by Abdul Khaliq, secretary general of Lok Janashakti Party.

For their sorry plight as depicted in the article, the Muslims themselves, largely, are responsible. They are Muslims only in name. They are badly divided among themselves. And, more importantly, they hardly follow the divine instructions given them in the Qur’aan. Had they – a majority among them, at least – followed those instructions meticulously, their position would not be as bad as that article depicts. For, in that case, they would be under the safe protection of Allah Almighty.

Kindly see, in this context excerpt below from Chapter 46 of QUR’AANIC STUDIES – A Modern Tafsir:


13. Inna allatheena qaloo rabbuna Allahu thumma istaqamoo fala khawfun AAalayhim wala hum yahzanoona

13. Those indeed who say, ‘Allah is Our Lord’, and then remain steadfast, they shall have no fear then, nor shall they grieve!5

5. Refer also, in this context, to similar Verse 41:30, which is a further elaboration of this Verse here. The Verse depicts, in a nutshell, the character of a believer in this world.

That character is missing in the Muslims of today. They may well declare, with their tongues, ‘Allah is our Lord’, but the declaration does not come from their hearts. Their belief is not strong enough to withstand the trials and tribulations of this worldly life. The weakness of their belief makes them neglect the Qur’aanic do’s and don’ts. So, Allah makes them suffer at the hands of other communities here. Allah subjects them to this suffering to make them realise their waywardness and turn back to absolute Trust in Him. If they do not learn their lesson, they may continue to suffer, not only here, but, Allah forbid, in the Hereafter as well!

Promoting Shirk

Promoting Shirk
Excerpt from Chapter 3 of QUR’AANIC STUDIES – A Modern Tafsir:

78. Wa-inna minhum lafareeqan yalwoona alsinatahum bialkitabi litahsaboohu mina alkitabi wama huwa mina alkitabi wayaqooloona huwa min AAindi Allahi wama huwa min AAindi Allahi wayaqooloona AAala Allahi alkathiba wahum yaAAlamoona

78. And, indeed, there is among them a section who so twist their tongues with the Book that you may think it is from the Book, and it is not from the Book. And they say it is from Allah and it is not from Allah. And they knowingly utter a lie about Allah.93

93. This Verse might well have been revealed in the perspective of the Jews and the Christians trying then to change the contents of the revealed Books with them. But, in our present-day perspective, we need not get concerned with what those people did then. The Qur'aan is valid for all times. Let us therefore look at this Verse in our own perspective. And let us first look to what we ourselves do with our own Qur'aan, before looking to what the Jews and the Christians are doing with their Books. We are fortunate, by Allah's Grace, that the Arabic text of the Qur'aan is divinely protected. But Arabic is not known to all the Muslims. In fact, a majority from among them do not know Arabic; nor are any sincere efforts made to make Arabic a compulsory subject for all Muslims to learn, all over the world. In this scenario, Satan has manoeuvred the majority Muslim mind into thinking that it is enough for them to learn just to read the Qur'aan. It is indeed a satanic handiwork to delude the intelligence of the Muslim mind against the imperative need to understand what one reads from the Qur'aan. The Moulvis and the Mullahs have, in the circumstances, become the Arbaab (Lords), besides the One Lord, of the common Muslims. For, they (the common Muslims) literally gulp down what their religious leaders tell them, right or wrong. And the Moulvis and Mullahs, many of them semi-literates themselves, often give the commoners a wrong picture of Islam. Besides, in the translations & commentaries of the Qur'aan in other languages, not only do human mistakes creep in inadvertently, but deviations are advertently made to cater to views promoting shirk.
